These Terms and Conditions ("Terms") govern your access to and use of the Freedom Select website and services at freedomselect.co.tz, operated by FREEDOM SELECT LTD ("Freedom Select", "we", "us" or "our"). By accessing the platform, registering an account, requesting a quotation or placing an order, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Freedom Select platform, you agree to be bound by these Terms and by our Privacy Policy and Returns & Refund Policy. If you do not agree to all of these Terms, you may not access or use our services.
2. Eligibility and Accounts
The platform is intended for persons aged 18 years or older. You are responsible for maintaining the confidentiality of your account credentials (phone number, email and password) and for all activity that occurs under your account. You agree to provide accurate, current and complete information and to keep it updated. Freedom Select reserves the right to suspend or terminate accounts that violate these Terms or that are reasonably suspected of fraud or misuse.
3. Use of the Platform
Freedom Select provides a digital marketplace connecting buyers with construction material suppliers and sellers. You agree to use the platform only for lawful wholesale, retail or B2B commerce purposes. You must not use the platform for fraudulent inquiries or transactions, to infringe intellectual property, to distribute malware, to scrape or overload our systems, or to interfere with the security or integrity of the platform.
4. Products, Pricing and Availability
Product descriptions, specifications and images are provided for general information and may vary. Prices displayed on the platform are subject to change based on market conditions and are quoted in Tanzanian Shillings (TZS) unless otherwise stated. We make reasonable efforts to display accurate pricing and stock information, but errors may occur. Where a pricing or availability error is identified before fulfilment, we may cancel or adjust the affected order and will notify you.
5. Quotations and Orders
For bulk or institutional requirements, the final price may be determined through the Request for Quotation (RFQ) process. A quotation becomes a binding contract only once it is accepted and payment terms are agreed by both parties. An order confirmation does not constitute acceptance where an error, fraud check or stock issue requires review. Title to and risk in goods pass in accordance with the applicable delivery or pickup arrangements.
6. Payments
Electronic payments may be processed through AzamPay and supported channels such as M-Pesa, Airtel Money, Mixx by Yas/Tigo Pesa, HaloPesa, bank transfer, Visa and Mastercard. Payment must be settled in full before dispatch unless credit terms have been agreed in writing. Payment records, references and confirmations may be used to verify transactions and prevent fraud.
7. Delivery and Pickup
Delivery timelines are estimates and may vary based on location, courier availability, weather and force majeure events. Delivery charges are calculated based on the destination and selected method. Where you select pickup, goods must be collected from the designated location within the notified period. Please inspect goods on delivery and report any issue promptly in line with our Returns & Refund Policy.
8. Returns, Cancellations and Refunds
Returns, cancellations and refunds are governed by our Returns & Refund Policy, which forms part of these Terms. Bulk materials such as cement and aggregate cannot generally be returned once offloaded at the site unless there is a verifiable quality issue.
9. Reviews and User Content
Approved product reviews may become publicly visible. By submitting content, you grant Freedom Select a non-exclusive right to display, moderate and use that content in connection with the platform. You must not post unlawful, defamatory, abusive, fraudulent, misleading or privacy-infringing material. We may moderate or remove content that violates these requirements.
10. Intellectual Property
All content on the platform, including text, graphics, logos, software and design, is owned by or licensed to Freedom Select and is protected by applicable laws. You may not reproduce, distribute or create derivative works without our prior written permission.
11. Limitation of Liability
Freedom Select acts as an intermediary marketplace in certain transactions. While we strive to ensure the quality of suppliers, we are not liable for direct, indirect or consequential damages arising from the use of products purchased through our platform unless covered explicitly by our Trade Assurance program. To the maximum extent permitted by law, our aggregate liability is limited to the amount paid by you for the affected transaction.
12. Indemnity
You agree to indemnify and hold Freedom Select harmless from any claims, losses, liabilities and expenses arising from your breach of these Terms or your misuse of the platform.
13. Suspension and Termination
We may suspend, restrict or terminate your access to the platform where you breach these Terms, where required by law, or where necessary to protect the platform, our users or third parties. Provisions that by their nature should survive termination will continue to apply.
14. Dispute Resolution
We encourage you to contact us first at support@freedomselect.co.tz so we can attempt to resolve any dispute amicably. Where a dispute cannot be resolved informally, it will be subject to the laws of the United Republic of Tanzania and the jurisdiction of its courts.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to conflict-of-law principles.
16. Changes to These Terms
We may update these Terms to reflect changes in law, technology, website functionality, service providers or business operations. The latest version will be published on freedomselect.co.tz with its effective date. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
